General Terms and
Conditions

These General Terms and Conditions (“GTC”) lay down the terms and conditions of using Cyberjump Trampoline Park (address: Commercial Centre Cora Lujerului, Iuliu Maniu Street no. 19, 6 District, Bucharest, Romania, “Cyberjump Trampoline Park”) operated by CYBERJUMP RO S.R.L.  (“Operator”), and using the [https://lujerului.cyberjump.ro/en/] website as well as the rights and obligations of the parties and other guests accompanying them (“Parties”).

The detailed, practical and security rules regarding the use of Cyberjump are laid down in the House Rules (“House Rules”), the regulations regarding the processing of the Parties’ data are laid down in the “Privacy Policy”, and information concerning the CCTV system is available in the “Information on Camera Usage”, which constitute the annexes of the GTC (GTC and its annexes shall be hereinafter jointly referred to as “Contract”).

 

I. DEFINITIONS

Guest: Any person actually using the services of Cyberjump Trampoline Park; in case the guest is a minor, Guest shall mean the adult accompanying, or the statutory representative of the minor person, as well as the person who places an order for the services of Cyberjump Trampoline Park.

Reservation: A Guest may use the services of Cyberjump Trampoline Park after making a reservation in advance.

Service: Cyberjump Trampoline Park is the largest trampoline facility in Romania, offering toys and equipment of the highest quality. The Guests may use the trampolines and other jumping equipment at Cyberjump Trampoline Park for sport and leisure purposes.

 

II. SCOPE AND VALIDITY

  1. Unless agreed otherwise by the Parties, this Contract shall be concluded for an indefinite period.
  2. The place of service provision under this Contract shall be the territory of Cyberjump Trampoline Park, Romania.
  3. The Contract shall be concluded by sending a written confirmation after finalizing the Reservation, and it shall remain in force until leaving the premises of Cyberjump Trampoline Park.

 

III.     REGISTRATION

  1. Only registered Guests can use Cyberjump Trampoline Park.
  2. Guests shall provide the following personal data during registration:
    (a) surname, first name, (b) date of birth, (c) e-mail address, (d) login password. The e-mail address provided during registration shall be used as the unique identifier (username) of the Guest. For minor Guests, the surname, first name, and date of birth of the child shall be provided.
  3. Guests may register at the Operator’s website (https://lujerului.cyberjump.ro) the registration portals at Cyberjump Trampoline Park, or by filling out a data sheet on site as a fallback option.
  4. The Guest shall provide true data during registration. The Guest shall acknowledge that the Operator may verify such data when entering the Cyberjump Trampoline Park, and entry may be denied if the provided data is untrue. Liability for any and all damages that may arise from providing incorrect or false data shall be worn by the registering Guest. The Operator is entitled to reject any incomplete or incorrect Reservation, and in case of doubt, the Operator is entitled to verify the Guest’s data.
  5. When finalizing the registration, the Guest shall accept the Privacy Policy, the GTC and the Statement of Individual Liability. The Guest shall declare that they are aware of and has accepted the fact that group pictures and videos may be taken and used by the Operator on the territory of Cyberjump Trampoline Park, and they may make a statement concerning the acceptance of newsletters.
  6. After submitting the registration, the system shall send a confirmation email to the Guest.

 

IV. RULES OF MAKING RESERVATIONS AND PURCHASING TICKETS

A, General rules

  1. Guests may enter Cyberjump Trampoline Park only at reserved times specified in advance or on site. Reservations may be made during working hours for intervals specified by ticket type.
  2. It may be possible to make a Reservation for more than 1 interval. The recommended period of use is 1 to 2 hours.

B, Booking and buying tickets on the Website

  1. For booking on the https://lujerului.cyberjump.ro website, the Guest shall specify the followings: the type of the ticket, the number of Guests, the date/s and time/s the Guest wishes to reserve. In case buying socks (wearing special socks is always required on the trampolines) is requested as well, the number and size of the socks shall also be specified.
  2. It is possible to make a reservation and to buy tickets for up to 30 persons.
  3. In case of booking more persons, the Guest making the reservation shall be responsible for the payment in full, regardless of the number of participants or any kind of internal settlement amongst them, and shall inform the other participants about the terms and conditions of entering the Cyberjump Trampoline Park as described below under Section D.1.
  4. For finalizing the booking and before the online payment, the Guest shall provide the following information: Full name, e-mail address, phone number, address. After the Registration and providing the necessary data, the Guest shall accept the terms and conditions of this GTC. The acceptance of the terms and conditions is tied to the registered user account of the Guest.
  5. After clicking the “Finalize purchase” button, the system proceeds to the Global Payments Romania payment site. Payment is only possible with the bank card types listed on the Cyberjump website, through the card payment terminal (VPOS). Here, the Guest shall provide the data necessary for the payment: Name and serial number on the bank card, the date of expiry and the validation code (CVC2 or CVV2). After this, the transaction will be finished by clicking the “Payment” button.
  6. The Global Payments Romania website will send an e-mail about the payment however, this shall not be deemed as the confirmation of the booking; in this regard the Operator will send a separate confirmation.
  7. The Operator is not responsible for any potential failures occurring during the online card payment process. At the payment, the Guest shall be responsible for having the authorisation for the payment method, and for the accuracy of the provided information. The Guest is also responsible for any damage occurring from providing a wrong e-mail address.
  8. After finishing the purchase the system will return to the website of Cyberjump, where the following data of the purchase may be seen: Global Payment Webpay reference number, Purchase order identification and the time of the booking.
  9. After a successful booking and purchase, the Guest will receive a confirmation e-mail together with the printable ticket containing the QR code (in pdf form) to the registered e-mail address. If the confirmation e-mail with the ticket is not arriving within 2 hours, and it is not in the spam folder either, the Guest shall contact the Reception at bilet@lujerului.cyberjump.ro.
  10. The confirmation e-mail sent to the registered e-mail address of the Guest shall be regarded as confirmation of the booking and thus as commencement of providing the Service.
  11. To enter Cyberjump Trampoline Park the Guest shall show the QR code on the ticket either printed or on his phone.
  12. The electronic invoice about the purchase will be sent via e-mail in 24 hours.
  13. The online ticket purchase is a contract for the provision of Services for leisure activities, and the Operator undertakes to provide these Services on a specific date or period. Thus, the Guest may not withdraw from the contract in accordance with Article 16 letter l) of the GEO no. 34/2014 on consumer rights in contracts concluded with traders, as well as for amending and supplementing certain normative acts, including subsequent amendments.
  14. Should the Guest not agree with the GTC and the House Rules, the Guest may cancel the order, and the ticket booking/purchase shall not be performed.

C, Booking and buying tickets on the Site

  1. It is also possible to purchase tickets at the Cyberjump Trampoline Park.
  2. It is possible at the site to specify the type of the ticket and time of booking, and to buy the ticket at the reception by cash or card.
  3. The provisions regarding the booking and payment and the acceptance of the terms of use (see Section D.1.) shall be applicable.

D, Entry (Check-in)

  1. When entering the site, the Operator shall be entitled to verify that the following conditions of use are met:
    1. The Guest has a ticket with a valid QR code;
    2. The Guest has registered and has accepted the Operator’s GTC, the House Rules, and has made a Statement of Individual Liability;
    3. The Guest is in suitable physical and mental state;
    4. The Guest weighs no more than 110 kg;
    5. Minor Guests may only enter Cyberjump Trampoline Park with a completed parental liability statement. For Guests under the age of 10 parental advisory is strongly recommended during the use of the trampolines;
    6. The Guest has a pair of special non-slip socks that are necessary for using the equipment.
  2. Cyberjump Trampoline Park may be used only if the conditions above are met, otherwise the Operator may deny entry to the site.
  3. If a ticket is purchased for more persons, each unregistered guest shall register before entering.
  4. Even if the Guest fails to arrive on his booking time and delays the starting date of the game, the ending time and the purchase price shall still remain unchanged.
  5. Upon entry, each Guest is provided with a wristband with a colour determined by the reserved period/s, which shall be worn during the entire time of using Cyberjump Trampoline Park. The Guest shall wear this armband at all times during their stay.
    The Ninja Warrior Track shall only be used by Guests with the height above 150 centimeters. The Ninja Warrior Track is not recommended for Guests with the fear of height. The Ninja Warrior Track may put heavy pressure on the arms, hands and upper body.

 

V. SERVICE FEE

  1. The Services of Cyberjump Trampoline Park may be used with a completed registration and an entrance ticket. The types and prices of tickets and other fees are published on the Cyberjump website under the ‘Prices’ menu, and are also available at the reception of Cyberjump Trampoline Park.
  2. In case of individual requests, major groups, company events, prize contests, coupon discounts etc., the Operator may determine other or ad hoc prices for using Cyberjump Trampoline Park.
  3. The Service Provider reserves the right to change the prices of tickets published on its website at any time. The published prices are gross prices and include the amount of VAT.
  4. The Operator reserves the right to unilaterally and unconditionally change the Service prices, as well as according to its interests. The Operator is entitled, before receiving any requests/purchase orders, to introduce new prices, to correct/amend prices, to offer or cancel discounted prices, with no prior information to the Guest.
  5. Information on the Services and Products presented on the Operator’s Website is subject to typing errors. Prices, product and Service information, and images may contain errors or inconsistencies.

 

VI. USING CYBERJUMP TRAMPOLINE PARK

A, Compliance with the House Rules

  1. Guests of Cyberjump Trampoline Park shall observe the House Rules and the rules displayed on each toy. The House Rules are published on the Cyberjump website under the ‘House Rules’ menu.
  2. In case of violation of the House Rules, the Operator is entitled to stop the game, and/or remove the violating Guest from Cyberjump Trampoline Park without any refund.
  3. By accepting these GTC, the Guest agrees that they shall not use the Service to harass, insult, defame other Guests or to violate any rights or lawful interests of any third party in any way.

B, Statement of Individual Liability

  1. Guests shall use the toys and equipment at Cyberjump Trampoline Park at their own risk.  Guests must sign the Statement of Individual Liability at the latest when entering Cyberjump Trampoline Park.
  2. For minors below the age of 18, the Statement shall be signed by an adult: either a parent, a statutory representative, or a responsible accompanying adult.
  1. The Statement of Individual Liability may be signed by the following means:
  1. a) Online, during or after registration (valid for 12 months)
  2. b) By submitting a paper-based document (valid for 1 entry); the printable Statement is available on the Cyberjump website under ‘Individual Liability Declaration’.
  1. If the Guest is a minor, a Statement of Liability by the accompanying adult shall also be provided.

The Statement of Parental Liability may be downloaded from the Cyberjump website or requested upon entry. If the parent of a minor has already registered, and the minor has been named during registration, the scope of the Statement of Individual Liability made during registration shall also cover the minor Guest.

 

VII.  BREACH OF CONTRACT, LIABILITY

  1. The Operator shall take all reasonable effort to ensure that the Service is operated in a safe and compliant manner, but is not liable for any loss or damage that may arise from the malfunction or other inadequacy of the systems used for the Service.
  2. The Parties expressly release the Operator’s liability for direct or indirect damages, and the Guest irrevocably and deliberately waives any legal action or claim against Cyberjump/the Operator or any of its employees (including owners, managers, employees, volunteers, coaches, agents, equipment suppliers, and insurers) in connection with theft, injury, damage, or death.
  3. To the extent permitted by the law, the Operator shall not be liable for the error-free operation of the systems used for the Service and/or reservations and ticket purchase; but is entitled to suspend the operation of the Cyberjump Trampoline Park and/or its website for improving, modifying, or maintaining the Service.
  4. The Guest shall use the Service at their own risk. Minor Guests shall use the service at the liability and risk of the registering person. The Operator especially shall not be liable for the behavior of other guests.
  5. The Operator shall be entitled to reject the reservation of the Guest in justified cases, for example in case of providing false or incomplete data, or abusing the Service or a ticket in any way.
  6. If the Operator has reason to believe that the Guest fails to use the Cyberjump Trampoline Park’s equipment in a contractual manner, it shall be entitled to prohibit the use of, and ban the Guest from Cyberjump Trampoline Park with immediate effect. In justified cases or upon request by the Guest, the event shall be recorded by the Operator in a report.
  7. The Guest may not jeopardize the security of the online surfaces used for reservations and purchasing tickets. Such behavior may result in civil and criminal sanctions. The Guest shall undertake not to use any tool, software, or procedure that may interfere, or may attempt to interfere, with the normal operation of online surfaces used for making Reservations and purchasing tickets, or with any other activity to be pursued on the Operator’s website.
  8. The Guests shall bear full liability for using the toys and equipment of Cyberjump Trampoline Park in an ordinary and intended manner. The Operator hereby excludes its liability for any and all damages that may arise from the unintended or unlawful use of Cyberjump Trampoline Park. In the above cases and/or in case of damaging the equipment, the Guest shall be obliged to pay compensation for the damages caused (financial damage and loss arising from any delay) to the injured party.
  9. The Guest shall bear full liability for any and all damages caused to any third party in the course of using Cyberjump Trampoline Park through the accountable behavior or omission of the Guest. This compensation duty shall include any and all demands and costs of any kind that may arise from any claim, shortfall, damage, lawsuit or other official proceeding, judgement or decision, procedural cost and attorney’s fee.
  10. For technical reasons relating to third-party insurance, any claim for damages shall be reported on site without delay and shall be recorded in a report by the staff; and the claim for damages and the amount thereof shall be specified in writing.

 

VIII. PRIVACY

  1. The Guest consents that all data disclosed in relation to the Service or learned by the Operator may be processed by the Operator in line with the Privacy Policy. The Guest also declares that they have obtained the consent of any third party (participating in the game) to handle their personal data in line with the current data protection legislation.
  2. In case of booking and buying tickets on the website the Guest accepts by clicking the “Finalize purchase” button that CYBERJUMP RO S.R.L. provides the following personal data stored in its user database at https://lujerului.cyberjump.ro to Global Payments Romania. (Strada Bd, Decebal, nr. 25-29,, Sector 3, București, România): user name, family name, given name, country, phone number, e-mail address.
    The purpose of data transmission: customer support for users, confirming transactions and fraud-monitoring in order to protect users.
  3. The Guest acknowledges that, for electronic monitoring purposes, the Operator has installed cameras in Cyberjump Trampoline Park at the locations indicated on the plan placed at the entrance of Cyberjump Trampoline Park, in line with the notice placed at the same place.
  4. During the registration and by entering Cyberjump Trampoline Park, the Guest gives their consent (based on implied conduct) to the Operator to use any and all group photos and/or panning video footages taken in the Park on online platforms (website, Google, social media).
  5. The Operator shall be entitled to send newsletters to the e-mail address provided by the Guest during registration, and to inform the Guest about the events, promotions, and other news of the Operator.

 

IX. AMENDMENT, MODIFICATION OF CONTRACT

  1. The registered Guest may modify their reserved date and time in regard of previously purchased tickets and with the same terms and conditions within 48 hours of the original reserved date and time. In such case the Guest shall choose from currently available dates and times. The Guest may only modify the reserved date and time and cannot convert tickets to vouchers. The Guest may not modify the type and the duration of their ticket.
  2. The reserved date and time may only be changed by the Guest for whom the ticket is purchased, having the ticket in their account. The Guest may solely modify the reserved date and time in their own account on the https://lujerului.cyberjump.ro webpage.
  3. Purchasing additional tickets cannot be done at the same time with ticket modification,
    only with a separate purchase in the online ticket-store.
  4. The Guest who purchased their ticket on the location without registration may modify their reserved date and time by sending an e-mail to the bilet@lujerului.cyberjump.ro e-mail address, or in person, within 48 hours before the original reservation’s date and time.
  5. Under consideration that the contractual relationship established based on these GTC is subject to the games/leisure activities that take place on a predetermined day and at a predetermined time, the Operator reserves the exclusive right to further unilaterally amend the provisions included in this contract regarding the operation, use, operating hours, access requirements, and fees charged for Cyberjump Trampoline Park. Such amendments shall not affect tickets and Services already purchased.
  6. The Operator shall publish any and all changes and amendments to these GTC, the Service, and the prices (for tickets or other services) on its website.

 

X. RESCISSION, TERMINATION OF THE CONTRACT

  1. The Guest cannot return the purchased ticket, as the Operator is providing such leisure related service under these GTC which has a specific use date and timeframe. These conditions apply to all Guests who are not regarded legally as “Customers” for all instances of purchase and in case of Guests who are legally regarded as “Customers” for ticket purchases at the reception.
  2. According to the provisions of Article 16 letter l) of the GEO. no. 34/2014 on consumer rights in contracts concluded with traders, as well as for the amendment and completion of some normative acts, including subsequent additions, the Guest shall not be entitled to rescind from the contract, since this Contract is concluded for free-time/leisure activity related services for which a date of performance (reserved date and time) has been specified in the contract.
  3. In any case when the Service is down, Operator shall inform Guests on Cyberjump Trampoline Park’s webpage (https://lujerului.cyberjump.ro). Registered Guests shall be informed in e-mail and additionally also about the possibility of returning and other use of tickets.

 

XI. VIP CARDS

    1. Use of service

The operator offers its guests the opportunity to purchase special passes valid for a longer period, under very favorable conditions, which are referred to as VIP Cards. The VIP Card’s details, conditions and current prices are available in person at the Reception of Cyberjump Trampoline Park, and on the Operator’s website at https://lujerului.cyberjump.ro/en/vip-card/.

Guests may purchase the service in person at the Reception of Cyberjump Trampoline Park, and on the Operator’s website at https://lujerului.cyberjump.ro/en/vip-card/.

  1. Applying for a VIP card

Adults (of 18 years of age or older) may register directly at https://lujerului.cyberjump.ro/en/vip-card/. For minors (under 18 years of age), a parent or legal guardian must register and request the VIP card on the minor’s behalf. During registration, it must be specified whether the application is for an adult or a minor under adult care, and provide all required information.

  1. Payment of the Monthly Fee

For 3- or 6-month VIP cards, the total fee for the chosen period must be paid upfront. Payments can be made online via credit card or in person at the park using any accepted payment method.

For subscription-based ‘Plus’ VIP cards, the Guest needs to register their bank card details with the Operator’s payment partner. Payments will be automatically charged on the same day each month.

  1. Receiving the VIP Card

Upon successful payment, the Guest will receive a confirmation email containing their virtual VIP card. The VIP card can be used by individuals only and is not transferable to third parties. VIP cards cannot be used for school group bookings.

Upon arrival to Cyberjump Trampoline Park, a photo ID must be shown at the reception together with the virtual VIP card proving the beneficiary of the card. The Operator does not accept VIP cards without a valid photo ID.

  1. Reservations by VIP membership

VIP members with an active membership card may reserve their tickets online. Reservations can be created, modified, or canceled by logging in to the Guest’s user profile at https://lujerului.cyberjump.ro/en/vip-card/. Guest can take these actions only with an active registration status (clicking on the green ‘+BOOK’ button).

  1. Cancellation of VIP membership

Subscription-based ‘Plus’ VIP cards can be canceled after completing the initial six-month loyalty period, by logging in to the Guest’s user profile at https://lujerului.cyberjump.ro/en/vip-card/ (by selecting the ‘Cancel VIP Card’ button and confirming termination).

Once canceled, the VIP card will be immediately deactivated, and its benefits will no longer be accessible. If a Guest cancels and later reapplies for a VIP card, a new six-month loyalty period will begin.

  1. Birthday discount for Premium VIP Cardholders

To claim a birthday discount, a birthday party for at least 8 participants must be booked, and the deposit for 6 packages paid online.

On the day of the event, an active Premium VIP card must be presented at the venue with a valid photo ID. The discount applies to one package only and must be redeemed by the cardholder (or their parent/guardian).

  1. Failure to deduct the subscription fee

If the monthly membership fee cannot be charged to the registered bank card (e.g. due to card expiration, insufficient funds, card blockage, or revocation of direct debit authorization), the Guest will receive an email notification. The Guest must resolve the issue and activate the payment within three (3) working days. If the payment is not activated within this timeframe, the card associated with the subscription will be deactivated. Reactivation is not permitted.

  1. Data processing and storage

The following personal data is collected and stored as part of the subscription:

the contracting party’s and member’s name, date of birth, address, email, telephone number, and membership number. Additionally, credit card data is securely stored by the Operator’s payment provider. By subscribing, the Guest explicitly consents to the processing and storage of this data, which is necessary to fulfill the subscription contract in compliance with applicable data protection laws.

  1. Changes to VIP Card conditions and prices

Operator reserves the right to modify VIP card conditions and pricing. All changes will be communicated to cardholders in writing.

 

XII. COMPLAINTS, DISPUTE RESOLUTION, JURISDICTION

  1. The Guest can make a verbal complaint, which will be investigated by the Operator immediately. If the Guest does not consent to the handling of the complaint or the immediate investigation of the complaint is not possible, the Operator shall take a written record about the complaint and their viewpoint, and give one copy to the Guest. In case of verbal complaint the copy of the record shall be given to the Guest on the spot; in case the complaint was made via telephone or other electronic way the copy should be sent with the substantive answer according to section XI.2.
  2. The Operator and the Guest shall attempt to settle any and all disputes via negotiations out of court. In case a legal dispute arises between the Operator and the Guest, the complaint shall be sent in written form to the Operator via post or e-mail (bilet@lujerului.cyberjump.ro). The Operator shall investigate the complaint and shall inform the Guest in writing about their findings via post or e-mail within 30 days. In case the Guest does not accept the findings of the Operator, he may request the Operator in writing to enter into discussions within 8 days of receipt of the response. If the discussions do not reach a conclusion within 14 days after receipt of the Guest’s request by the Operator, the Guest may seek remedy in the competent courts of Bucharest or other authority or in Arbitration Board.
  3. In the event of consumer disputes, the Guest is entitled to address the competent advisory body at the main/secondary place of residence.
  4. In the event of a breach of consumer rights, the Guest is entitled to address the competent consumer protection authority at the place of residence.
  5. In accordance with the provisions of Government Ordinance No. 38/2015 on alternative dispute resolution (hereinafter referred to as “ADR”) between consumers and traders, the Customer may voluntarily file complaints against the Operator of entities that independently, impartially, transparently, effectively apply alternative dispute resolution procedures, in a quick and equitable manner, in order to ensure a high level of consumer protection and the proper functioning of the market (hereinafter referred to as “GO 38/2015”). OG 38/2015 shall apply to out-of-court settlement procedures for national and cross-border disputes arising from sale or service contracts concluded between a Romanian trader and a consumer resident in the European Union through the intervention of an entity responsible for alternative disputes settlement, acting in Romania, which shall rule or order a solution. Should a dispute between the Customer and the Operator not be resolved based on a complaint submitted directly by the Customer to the Operator, the Operator shall inform the Customer on the possibility to address the ADR entity and the SOL platform (European online dispute resolution platform, called the SOL platform – a digital tool created by the European Commission to facilitate the independent, impartial, transparent, effective, expeditious and equitable out-of-court settlement of disputes concerning contractual obligations arising from sale or service contracts to a consumer residing in the European Union and a trader established in the EUR). In order to address the ADR entity and the SOL platform, the Customer shall access the webpage: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=RO
  6. Should the intervention of the ambulance, police, firefighters or other competent authorities be required, in the event of an emergency, please dial the emergency number: 112.

XIII.  MISCELLANEOUS PROVISIONS

  1. According to the statutory provisions on copyright, the Operator’s website (https://lujerului.cyberjump.ro/en/) is a unique assembly and collections of works, on that base, this website and every content placed on it is under copyright. It is prohibited to use the website’s external display (design) such as designs for fine art which is made by computer graphics, the software, the rules, the policies and by-laws, furthermore to apply any application which can modify the website or the part of the website without the prior written consent of the rightholder. To take over from the website or any content from the database can be performed with the prior written consent of the rightholder and with the reference of the website and the acknowledgement of the source. The rightholder is the Operator.
  2. Any and all issues not regulated herein shall be subject to the relevant provisions of GEO 34/2014 on consumer rights in contracts concluded with traders, as well as for amending and supplementing certain normative acts, including subsequent amendments, the provisions of the Romanian Civil Code, and other relevant pieces of legislation.

These GTC shall enter into force on 20 December 2024.
