1. RAFFLE ORGANIZER
1.1 The organizer of the raffle is: CYBERJUMP RO SRL, with registered office in Bucharest, Sector 2, Str. Gara Herăstrău nr. 4B, space 14, 9th floor, Romania, Trade Register registration number: J40/21715/2021, tax registration code: RO 45342755, represented by Stefan Fritsch and Ágnes Pap-Tóth, administrators (hereinafter referred to as “Organizer”).
1.2. The Promotional Raffle is organized on the basis of these Official Rules (hereinafter referred to as “Official Regulation”), drawn up in accordance with the legal provisions contained in Government Ordinance no. 99/2000, as amended and supplemented, which is binding for all Participants.
1.3. Participation in the Promotional Raffle implies the acceptance by the Participants of the provisions of these Official Regulations and the obligation to comply with them. By participating in this Promotional Raffle, Participants will be deemed to have fully acknowledged the provisions of these Official Regulations.
1.4 The Official Rules as well as the details of the Promotional Tombola are available free of charge on the Organizer’s official website (www.cyberjump.ro) and are supplemented by the Organizer’s Terms and Conditions available on the website www.cyberjump.ro.
2. TIMEFRAME OF THE RAFFLE
Starting date and time for collecting tickets: 1 March 10:00
Closing date and time for collecting tickets: 20 June 16:00
Weekly draws: Every Friday evening from March 7 to June 20 (16 weeks in total) in Cyberjump Trampoline Park.
Monthly draws: in Cyberjump Trampoline Park

3. CONDITIONS FOR PARTICIPATION
3.1 In order to be eligible to participate in the Promotional Raffle and to be able to win the prizes offered by the Organizer by drawing lots, Participants must meet the following express conditions, cumulatively:
(i) be natural persons with domicile or residence in Romania, who have reached the age of 18;
(ii) to comply exactly with the steps described in the framework of this Official Regulation;
(iii) not to be employees of the Organizer, their relatives up to the third degree inclusive, as well as spouses;
(iv) accept and comply with the provisions of this Official Regulation.
(v) Fill out a raffle stub with their name and e-mail address.
(vi) Drop the completed stub in the designated box located in a visible location in the park.
3.2. Failure to comply with any of these provisions/conditions will result in the annulment of the registration / right to award the prize.
4. PRIZES
4.1. The prizes to be awarded during the Promotional Raffle consist of:
– Weekly prizes: 1 voucher card per draw, worth 2800 V-Bucks, or a PlayStation top-up card of equivalent value (16 in total)
– Monthly prizes: 1 PlayStation5 console per draw (5 in total)
Prizes cannot be exchanged for cash and cannot be transferred to another person.
4.2 The total value of the prizes is 15 000 lei VAT included.
4.3. Within the Promotional Raffle it is not possible to award the cash value of the prizes offered or other benefits instead of prizes.
4.4 Any obligation of a fiscal nature in relation to the prize won is the sole responsibility of the winner, except for the tax to be calculated, withheld, declared and paid to the state budget, according to the legal provisions in force for prizes whose value exceeds 600 (six hundred) lei. (Law no. 227/2015 on the Tax Code). Prizes worth at least 600 lei shall always be taxed, through withholding by the Organizer.
5. MECHANISM, DESIGNATION OF WINNERS AND AWARDING OF PRIZES
5.1 Draws will be conducted by a committee of 3 members appointed by the Organizer. The draws will take place after the completion of the Promotional Raffle, in Cyberjump Trampoline Park in order to award the prizes, will be carried out under the direct supervision of a committee which will include representatives of the Organizer. The video recording will be kept for a period of 48 (forty-eight) hours after the draw, respectively after the designation and announcement of the winners, in the event of any disputes.
5.2 Winners will be chosen at random from the tickets deposited in the collection boxes. All deposited coupons will participate in the weekly and monthly draws, but already winning coupons will not be re-entered into the raffle. The draws will determine the winners and three (3) reserves for each category. In the event that one of the Participants designated as the winner does not meet the validation conditions in the Official Regulations, the prize will be awarded to a reserve Participant. The Drawing Committee will draw up a report of the winners. The draw will be carried out by a committee composed of 3 (three) representatives of the Organizer.
5.3 In order to be considered valid, appeals must be formulated within 24 (twenty-four) hours, after the winners have been designated and announced, by registering the appeal at the e-mail address provided by the Organizer for the contest, namely info@lujerului.cyberjump.ro, along with the contact details.
5.4 The contestation registered within the stipulated deadline shall be solved by a committee appointed by the Organizer, within a maximum of 30 (thirty) days from its registration, the result of the deliberation being sent by e-mail.
5.5 The Organizer disclaims any liability in the event that any of the Participants designated as winners does not respond to messages from the representatives of the Organizer (each winner will be contacted by a written message via e-mail during a single day) within the aforementioned period of 3 (three) days. If within this period of time, the Organizer is unable to communicate with any Participant designated as a winner, then he/she will be declared a non-winner and the first Participant drawn as a reserve will be declared the winner. In the event that none of the Participants drawn as winners or reserves can be contacted, another draw will be made to determine the winner.
5.6 After receiving the Organizer’s message, the winners will send a confirmation message to the Organizer, as well as his/her contact details consisting of: name, surname, ID data, telephone number; within 3 (three) working days from the date of his/her designation as winner.
5.7 By the message sent to the Organizer, the winning Participant agrees to receive the prize and to the processing of personal data for the purpose of awarding the prize.
5.8 The personal data requested in the communication with the Organizer’s representative are necessary in order to validate the Participant and to prevent possible fraud in the process of awarding prizes.
5.9 Each Participant declared a winner by the drawing of lots has the possibility to opt, with regard to the refusal to take possession of the prize. The refusal expressed under these conditions will be recorded by the Organizer’s representative and is considered to be irrevocable, the Organizer declaring such a Participant as a non-winner, being contacted in this regard the next participant designated as the reserve of that prize, as provided in Article 7.8.
5.10 After validation, winners will be notified by e-mail within [e.g. “48 hours”] of the draw.
Winners will pick up their prize in person at the Cyberjump Trampoline Park, where the draw occured. The organizer will verify the identity of the winner by checking the winner’s identity card.
5.11 Prizes will only be awarded to the winner. In order to obtain the Prize, the winner will have to identify him/herself when collecting the parcel.
5.12 The situations in which the winners cannot be contacted in order to pick up the packages containing the prizes sent by the Organizer, or refuse to take possession of them, will result in forfeiture of all their rights, and the unclaimed prizes will remain at the disposal of the Organizer. Winners cannot claim and cannot obtain the cash value of the prizes won.
5.13 In accordance with Art. 41 para. (2) of O.G. no. 99/2000, no other additional direct or indirect direct or indirect expenses are charged to the participants.
5.14 If a winner does not claim their prize within 5 working days of notification, the Organizer reserves the right to nominate another winner.
6. FORCE MAJEURE AND FORTUITOUS EVENT
6.1. According to the legislation in force, force majeure means any external, unforeseeable, absolutely invincible and unavoidable event and fortuitous event is that event that cannot be foreseen or prevented by the party who is bound to fulfill certain obligations under these Official Rules.
6.2. If a situation of force majeure or fortuitous event involves or delays in whole or in part the execution of the Official Rules and the continuation / implementation of the Promotional Tombola by the Organizer, the Organizer will be exempt from liability for the fulfillment of its obligations for the period during which this fulfillment will be involved or delayed, according to art. 1.351 of the Civil Code. The Organizer, if it invokes force majeure or fortuitous event, is obliged to notify the participants in the Campaign of its existence within 5 (five) working days of the occurrence of the case of force majeure or fortuitous event.
7. LITIGATIONS
7.1. Any disputes arising between the Organizer and the Participants in this Promotional Raffle will be resolved amicably or if this is not possible, the disputes will be settled by the competent courts of law at the headquarters of the Organizer.
7.2. Any complaint related to the development of the Promotional Raffle will be made in writing, within 5 days from the date on which the event causing the damage was known or should have been known.
8. PROCESSING OF PERSONAL DATA WITHIN THE PROMOTIONAL RAFFLE
8.1. In order to carry out the Promotional Raffle, the Organizer mentioned in art. 1 will process, as controller, the personal data of Participants.
8.2. The contact details of the Organizer referred to in art. 1 may be used to address queries and for the exercise of rights by the data subjects.
8.3. In the framework of the Promotional Raffle, the Organizer will collect from the Participants the following categories of personal data: name, surname, email address
As regards the validated winners, the Organizer collects and processes the following personal data: name, surname, email, ID card data. These data will be collected and stored exclusively in the case of winners in order for the Organizer to be able to register in the accountancy the awarding of the prizes and to prove the awarding of the prizes.
8.4. Purpose of processing. The personal data of the participants in the Raffle will be processed by the Organizer in order to organize and run the Raffle, to designate and validate the winners, as well as to award the prize and to fulfill the financial-accounting obligations of the Organizer.
8.5 The data will be processed for the purposes of the legitimate interest of the Organizer for the running of the Campaign and for the fulfillment of its legal obligations, through the acceptance by the data subject of the Official Rules and any annexes thereto. Registration of the Participant (data subject) in the Raffle n implies the processing of personal data.
8.6. With regard to the personal data of the winner for the Organizer’s accounting records, they will be stored, in accordance with the applicable legal provisions on financial-accounting matters, for 10 (ten) years from the end of the financial year in which the prize was awarded.
8.7. Upon expiry of the storage period of personal data, the Organizer will delete/destroy these data from the means of processing and storage.
8.8. Rights of data subjects
In order to ensure fair and transparent processing, Participants – as data subjects – have the following rights:
(i) the right to withdraw consent to the processing at any time, without this affecting the lawfulness of the processing carried out on the basis of the consent prior to its withdrawal, the data being deleted in accordance with the data subject’s request and in compliance with applicable legal provisions;
(ii) the right to request access to personal data;
(iii) the right to request rectification of personal data;
(iv) the right to request erasure of personal data
(v) the right to restriction of processing;
(vi) the right to object to processing, unless otherwise provided by law;
(vii) the right to data portability;
(viii) the right to lodge a complaint with the National Supervisory Authority for Personal Data
Processing if the above rights have been violated or if he/she has suffered any damage as a result of unlawful processing of personal data.
8.9. Participants may exercise the aforementioned rights by a written request, dated and signed, sent to the Organizer’s registered office address mentioned in art. 1 OR by a request sent by email to info@lujerului.cyberjump.ro.
8.10. The Organizer undertakes to implement appropriate technical and organizational measures in order to ensure an adequate level of security of the personal data of the Participants in the Campaign. In assessing the appropriate level of security, particular account shall be taken of the risks presented by the processing of personal data, arising in particular, accidentally or unlawfully, from the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of or unauthorized access to personal data transmitted, stored or processed
8.11. The personal data of the winner of the Campaign will be processed in accordance with the applicable legal provisions, namely the EU Regulation No. 679/2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.
9. LIABILITY OF THE ORGANIZER
The Organizer assumes no responsibility for any event that causes the impossibility to participate in the Raffle or affects the proper conduct of the activities described in these Official Rules, as a result of any restrictions and/or limitations of any nature.
The Organizer’s liability is strictly limited to the awarding of the prizes.
The Organizer assumes no liability for any accident suffered by a winner or for any other damages incurred in connection with the voucher offered.
The Organizer assumes no responsibility for the failure of fixed and/or mobile telephone networks or Internet networks.
Participants who have lost their status as potential winners or winners are not entitled to claim any of the vouchers by any other means.
10. OFFICIAL RAFFLE RULES
10.1. The Official Rules of the Promotional Raffle are drawn up and will be made public according to the applicable legislation, being accessible free of charge to any applicant during the entire duration of the Promotional Raffle on the website www.cyberjump.ro and in the physical locations of the Organizer.
10.2. By participating in the Promotional Raffle, Participants expressly and unconditionally agree to these Official Rules and undertake to fully comply with its terms and conditions. Any failure to comply with the provisions of these Official Rules may result in disqualification of the Participants and non-award of potential prizes
10.3. The Organizer reserves the right to modify these Official Rules, without compensation, any modification being made public on the website www.cyberjump.ro .
10.4. Any amendment to the Official Regulations shall be the subject of an addendum to the Official Regulations and shall be authenticated by the Notary Public. Amendments shall not have retroactive effect, but shall take effect from the date on which they were made known to the public.
10.5 The Organizer does not assume any responsibility for the participants’ non-awareness of changes, as long as they are made public on the website www. cyberjump.ro.
10.6 In the event that the Organizer suspends or discontinues the Promotional Raffle, a notice of suspension or discontinuation will be made public on the website www.cyberjump.ro – 24 (twenty-four) hours in advance.
10.7. By publication of the respective announcement, the Promotional Raffle will be suspended or interrupted as of right and no interested party will have any right to claim the continuation of the Promotional Raffle or any kind of compensation provided that, in the event that the Promotional Raffle is suspended before the expiry of its Duration as provided in these Official Rules, the Organizer will award the relevant prizes to the winners designated by the date of suspension of the Promotional Raffle, in accordance with these Official Regulations.
